WebNation Terms of Service
- You are responsible for all use made of your
WebNation account.
- WebNation network services may be used only
for lawful purposes. Transmission of any material in violation of
any federal, state, or local regulation is prohibited. This
includes, but is not limited to: copyrighted material, material
legally judged to be threatening or obscene, or material protected
by trade secret. You agree to indemnify and hold harmless
WebNation, its officers, directors, and employees from any claims
resulting from use of your account which damages you or another
party.
- Any use of other networks through WebNation's
network must comply with the rules appropriate for that other
network. You shall not disrupt any network service or allow any
person using your account to disrupt any network service. Your
account shall not be used in any manner which disrupts service for
any other WebNation customer.
- You shall post no commercial message to any
Usenet newsgroup whose charter does not expressly permit such
messages. You shall send no unsolicited commercial e-mail. You
shall not post any forged email, Usenet, or other message. A
forged message is any message or communication you send that
purports to be from any person other than yourself. This paragraph
does not prohibit the posting of anonymous messages so long as
such messages do not purport to be from someone other than
yourself.
- WebNation cannot and does not exercise any
control whatsoever over the content of the information passing
through its network.
- WebNation makes no warranties of any kind,
whether express or implied, for the service it is providing.
WebNation also disclaims any warranty of merchantability or
fitness for a particular purpose. WebNation will not be
responsible for any damage you suffer. This includes loss of data
resulting from delays, nondeliveries, misdeliveries, or service
interruptions caused by its own negligence or your errors or
omissions.
- Use of any information obtained via the
WebNation network service is at your own risk. WebNation
specifically denies any responsibility for the accuracy or quality
of information obtained through its services.
- You shall not assign, sublet, or resell any
portion of WebNation network services without the prior written
consent of WebNation. Any such assignment, subletting, or resale
shall be void.
- You may cancel service in writing at any time
with no penalty. WebNation reserves the right to change the rates
by notifying you 30 days in advance of the effective date of the
change. Invoices are delivered by electronic mail. Paper invoices
are sent only on request, and an additional fee is charged for
each paper invoice.
- Payment is due within 15 days of the billing
date. If you do not receive your invoice on your billing date
(which is shown on your new-user information sheet), it is your
responsibility to contact WebNation to determine the full amount
due and make payment. If your payment is returned to us unpaid you
are immediately in default and subject to a returned-check charge.
Accounts unpaid 30 days are subject to service interruption. Such
interruption does not relieve you from the obligation to pay the
periodic account charge. Only a written request to terminate your
service relieves you of your obligation to pay the periodic
account charge. An act of default accelerates payments to be due
immediately, as credit is no longer being extended.
- If you default, you agree to pay WebNation its
reasonable expenses, including attorney and collection-agency
fees, incurred in enforcing its rights under these Terms and
Conditions.
- WebNation reserves the right to refuse any
order or to refuse to renew any account at its sole
discretion.
- These Terms and Conditions supersede all
previous representations, understandings, or agreements and shall
prevail notwithstanding any variance with terms and conditions of
any order submitted. WebNation reserves the right to modify these
Terms and Conditions by posting an updated version of them at
http://www.webnation.com/tos.html 10 days in advance of the effective date of the
change.
- Use of WebNation network services constitutes
acceptance of these Terms and Conditions. Breach of these Terms
and Conditions is grounds for account cancellation.
